Asia Tech Wire (Oct 10) -- OpenAI has asked a court to dismiss a lawsuit filed by Tesla CEO Elon Musk, claiming that he is litigating for competitive advantage.
In February, Musk filed a lawsuit claiming that he and the two co-founders of the ChatGPT developer had an agreement that OpenAI was to be a non-profit organization when he provided funding and other support for the creation of OpenAI, but that OpenAI went against its founding goals and mission to pursue profits instead.
And in June, Musk withdrew the lawsuit, then re-filed it in August.
OpenAI filed a motion in Oakland on Tuesday asking a U.S. federal judge to dismiss Musk's lawsuit.
In the filing with the court, OpenAI said Musk's lawsuit was a continual practice of harassing OpenAI for its own competitive advantage.
Musk had supported OpenAI's goal of seeking to safely and beneficially develop general-purpose artificial intelligence, but dropped his support for that goal after realizing that he was unable to lead the process, the filing said.
OpenAI also claims that Musk has launched his own AI company, and is trying to use the U.S. justice system to gain a competitive advantage in the field.
