According to three people familiar with the matter, Walmart's Indian e-commerce platform Flipkart has reportedly appealed to India's Supreme Court against a district court ruling that allowed an antitrust investigation against Flipkart and Amazon to proceed.
The case began in January last year. At the time, India's antitrust agency, the Competition Commission of India (CCI), announced that it had ordered an investigation into alleged violations of fair competition laws by Amazon and Flipkart.
The CCI said at the time that exclusivity agreements between cell phone brands and e-commerce platforms, as well as allegations of preferential treatment of specific sellers by e-commerce companies, were the reasons for their antitrust investigations against Amazon and Flipkart.
In response, Amazon and Flipkart challenged the case and took CCI to court. And the court ordered a stay of the antitrust investigation against Amazon and Flipkart. For this reason, the investigation was put on hold for more than a year.
In June 2021, a court in India ruled to allow the antitrust investigation to proceed. Subsequently, Amazon and Flipkart filed another appeal. On Friday, India's South Karnataka High Court rejected the two companies' request and allowed CCI to continue the investigation.
Flipkart today filed another lawsuit for the third time, hoping that the Indian Supreme Court will block the CCI's investigation, according to sources familiar with the matter. The information on the Supreme Court of India's website also shows that Flipkart has indeed filed a lawsuit against CCI and other parties.
In addition, the sources also said that after Flipkart, Amazon would also appeal to the Indian Supreme Court.
