China New Energy announced on the Hong Kong Stock Exchange that the company recently received a civil complaint and other related litigation materials from the Hunan Provincial High People's Court. According to the complaint, the plaintiff CATL filed a claim for intellectual property infringement against the company and other defendants (third parties independent of the company and its related parties) regarding the top cover assembly of secondary batteries and the invention patent No. ZL202011086325.8 for secondary batteries. The main litigation requests in the case include: (1) claiming that the company immediately stop infringing the plaintiff's patent rights in the lawsuit, including stopping the manufacture, sale and promise to sell products that infringe the patent rights in the lawsuit; (2) claiming that the company compensate the plaintiff for economic losses of RMB 110 million; (3) claiming that the company compensate the plaintiff for reasonable expenses of RMB 1 million incurred to stop the infringement. The patent in the lawsuit belongs to the battery top cover structure. The company has a completely independent intellectual property layout based on this type of battery top cover structure, and the company's products do not infringe. At present, the lawsuit involved in this announcement has not yet been heard in court. This lawsuit is not expected to have a significant adverse impact on the company's current and future production and operations.
