Netflix loses first trial against SK Broadband over network fee dispute

According to Yonhap News Agency, the Seoul Central District Court ruled against the plaintiff in the first instance in a civil panel case filed by Netflix, an Over-the-top media service (OTT) platform, against South Korea's SK Broadband Corp.

The court dismissed Netflix's request for "confirmation of non-existence of negotiation obligations" and rejected its request for "confirmation of non-obligation to pay network usage fees."

SK Broadband filed an application for mediation with the Korea Broadcasting and Communications Commission in November 2019 to "negotiate with Netflix on the network usage fee," but Netflix refused mediation and filed the lawsuit mentioned above in April 2020.
